Article 1 – Identity of the seller
These terms and conditions are used by:

Article 2 – Scope
1. These terms apply to every offer and agreement under which a consumer purchases a product from SnapSelect.nl B.V. through gustique.eu.
2. GUSTIQUE and gustique.eu are trade names of SnapSelect.nl B.V. SnapSelect.nl B.V. is always the legal seller and contracting party.
3. These terms apply to consumer sales and deliveries in the Netherlands and Belgium.
4. The applicable terms are made available before the order is placed in a way that allows the consumer to read, download and retain them. The version applicable at the time of ordering is included in or attached to the order confirmation on a durable medium, so the consumer can retain that version unchanged and access it later. A link only to a changeable webpage is not sufficient for this purpose.
5. Any deviation is valid only when expressly agreed in writing. Mandatory consumer rights always continue to apply.
Article 3 – Offer and product information
6. The offer clearly describes the product’s principal characteristics, contents, price, availability and any specific conditions.
7. Images represent the products as accurately as possible. Colours may vary slightly due to screen settings. Such a limited display variation does not affect the consumer’s right to receive a product that conforms to the contract.
8. Before use, the consumer must read and follow the product information, ingredient information, warnings and instructions for use.
9. An offer remains valid while displayed on the website and while stocks last, unless a different validity period is stated.
10. An obvious typographical, publication or pricing error does not bind SnapSelect.nl B.V. where an average consumer could reasonably have understood that an error had occurred.
Article 4 – Ordering process and conclusion of the contract
11. The consumer selects the products, checks the shopping cart, enters the requested ordering and delivery details, chooses a payment method and is given an opportunity to identify and correct input errors before payment.
12. By clicking a button that clearly indicates an obligation to pay, the consumer places an order with an obligation to pay.
13. The contract is concluded when SnapSelect.nl B.V. confirms the order by email.
14. The order confirmation contains the principal order information. The applicable terms, withdrawal information and model withdrawal form are included in the email or attached as a file on a durable medium so the consumer can retain them unchanged.
15. Orders may be placed in Dutch or English. The contract is concluded in the language used during checkout.
16. SnapSelect.nl B.V. retains order information for the applicable statutory retention periods. The consumer may request a copy of available order information through CustomerCare@gustique.eu.
17. If the consumer notices an error in the information supplied after ordering, the consumer should contact customer service as soon as possible. Changes are possible only while the order has not yet been processed or dispatched.
Article 5 – Prices and payment
18. All consumer prices are displayed in euros and include applicable VAT.
19. Shipping charges and any other unavoidable charges are clearly displayed before the consumer submits the order.
20. Standard shipping to the Netherlands and Belgium is free for all orders. If another or additional delivery service is available, its cost will be clearly displayed before payment.
21. Available payment methods are displayed during checkout. Payment is made through the selected method and subject to the conditions shown for that method.
22. For the delivery commitment, an order is considered paid when the payment provider has successfully confirmed payment.
23. SnapSelect.nl B.V. does not charge a payment surcharge unless it is clearly disclosed in advance and permitted by law.
24. Ownership of the product remains with SnapSelect.nl B.V. until the full amount due has been paid.
Article 6 – Delivery
25. Delivery is made to the delivery address supplied by the consumer.
26. For addresses in the Netherlands, an in-stock order fully paid before 22:00 on a business day will normally be delivered on the next available delivery day, provided that the delivery address is correct and complete and the carrier delivers to that address on that day.
27. For addresses in Belgium, the usual delivery time is one to two business days after payment is confirmed, provided that the products are in stock and the delivery address is correct and complete.
28. A business day means Monday to Friday, excluding public holidays that affect processing or delivery.
29. Orders paid after 22:00, during a weekend or on a public holiday will be processed from the next business day.
30. Where a different delivery period is expressly stated for a specific product or during checkout before ordering, that specific period applies. Other periods stated here are delivery expectations based on normal operations; any delivery date or period expressly agreed with the consumer remains binding.
31. If a delay is expected, SnapSelect.nl B.V. will inform the consumer as soon as possible. If an agreed delivery period is exceeded, the consumer may give the seller a reasonable additional period for delivery, unless the law permits immediate termination. If delivery does not take place within that additional period, the consumer may terminate the contract in respect of the undelivered part.
32. Following valid termination for non-delivery, the relevant amounts will be refunded within fourteen days.
33. The risk of loss or damage passes to the consumer when the consumer, or a third party appointed by the consumer other than the carrier, receives the product.
Article 7 – Right of withdrawal
34. As a general rule, the consumer may withdraw from an online purchase without giving a reason within fourteen calendar days.
35. The withdrawal period begins on the day after the consumer, or a third party appointed by the consumer other than the carrier, receives the product. If products from one order are delivered separately, the period begins on the day after receipt of the last product.
36. The consumer may exercise the right of withdrawal through:
37. the clearly visible Withdraw from purchase function in the footer of gustique.eu;
38. an email to CustomerCare@gustique.eu;
39. an unequivocal written statement sent to the address in Article 1; or
40. the model withdrawal form available through the footer and directly at https://gustique.eu/en/pages/modelformulier-herroeping.
41. Use of the model form is not mandatory. The statement must, however, clearly communicate the consumer’s decision to withdraw from the contract.
42. When the online withdrawal function is used, the consumer promptly receives confirmation by email or another durable medium containing the content of the withdrawal statement and the date and time of submission.
43. After notifying us of withdrawal, the product must be returned within fourteen days to:

44. The consumer bears the direct cost of return shipping for an ordinary withdrawal. Use a tracked method where reasonably available and retain proof of dispatch until the return has been completed. This practical recommendation does not limit the statutory reimbursement rules.
45. The consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the product’s nature, characteristics and functioning.
46. Additional information about registering, packing and sending a return is provided in the Returns, Withdrawal and Refund Policy.
If the final day of a statutory withdrawal or return period falls on a Saturday, Sunday or applicable public holiday, the period ends on the next working day where required by applicable law.
Article 8 – Sealed hygiene products
47. Every 15 ml GUSTIQUE bottle and every GUSTIQUE 5 × 3 ml set is supplied with a specific, recognisable, tamper-evident hygiene seal.
48. Because of their nature and intended intimate personal use, these products are not suitable for return for reasons of health protection and hygiene once the hygiene seal has been broken.
49. The statutory right of withdrawal is lost for the relevant sales unit once its hygiene seal has been broken after delivery.
50. Opening only the neutral outer shipping package does not break the product seal and does not affect the right of withdrawal.
51. A sales unit whose specific hygiene seal remains fully intact may be returned within the withdrawal period.
52. This exception does not restrict statutory rights where a product is damaged, incorrectly supplied or does not conform to the contract.
Article 9 – Refund following withdrawal
53. Following a valid withdrawal, SnapSelect.nl B.V. refunds all payments received for the withdrawn product.
54. Standard shipping to the Netherlands and Belgium is free, so there is no original standard-delivery charge to reimburse.
55. If the consumer selected a paid additional or more expensive delivery method, the amount above free standard delivery does not have to be reimbursed.
56. The refund is made within fourteen days after receipt of the withdrawal notice. SnapSelect.nl B.V. may withhold reimbursement until the product has been received or the consumer supplies evidence of having returned it, whichever occurs first.
57. The refund is made using the same payment method as the original transaction, unless the consumer expressly agrees to another method that does not incur fees.
58. No fee is charged for the refund.
Article 10 – Damaged, incorrect or non-conforming products
59. Consumers are entitled to goods that conform to the contract and to all statutory conformity and guarantee rights.
60. For consumers in the Netherlands, statutory protection is not capped at a fixed two-year period: it lasts for as long as the consumer may reasonably expect the product to last under normal use. For consumers in Belgium, new goods are in principle covered by a two-year statutory conformity guarantee, in addition to other mandatory rights.
61. If a product arrives damaged, is the wrong product or does not meet what may reasonably be expected, contact CustomerCare@gustique.eu. Preferably include the order number and, where practical, clear photographs. Prior return approval or an RMA is not required to exercise statutory rights.
62. Repair or replacement is provided free of charge and without significant inconvenience where that is the appropriate first remedy under the law, unless the chosen remedy is impossible or disproportionate.
63. A price reduction or termination and reimbursement is available where the statutory conditions are met, for example if repair or replacement is impossible, is not completed in time or without significant inconvenience, or the lack of conformity is sufficiently serious.
64. SnapSelect.nl B.V. bears the necessary direct return and shipping costs for a damaged, incorrect or non-conforming product. Where possible, contact us before dispatch so we can provide a return label or clear reimbursement instructions; doing so is not a condition for the existence of statutory rights.
65. A commercial or manufacturer’s guarantee never limits statutory conformity or guarantee rights.
Article 11 – Consumer responsibilities and safe use
66. The consumer provides correct and complete ordering, contact and delivery information.
67. The consumer uses and stores the product in accordance with its intended use, product information and use and storage instructions.
68. If the product seal is already damaged on delivery, or if there is doubt about the product’s condition or safety, do not use it and contact CustomerCare@gustique.eu.
69. Nothing in these terms excludes liability or consumer rights where exclusion is prohibited by mandatory law.
Article 12 – Complaints
70. Complaints may be submitted through CustomerCare@gustique.eu or in writing to the address in Article 1.
71. Please include your name, order number, a clear description of the complaint and the preferred solution where possible.
72. SnapSelect.nl B.V. acknowledges receipt of a complaint within two business days.
73. We aim to provide a substantive response within fourteen calendar days. If more time is required, we will explain why and provide an expected further handling period.
74. SnapSelect.nl B.V. is not currently affiliated with a sector-specific disputes committee.
75. If a complaint submitted directly to us cannot be resolved, we will provide the consumer on a durable medium with information about the recognised alternative-dispute-resolution entity relevant to the dispute and state whether we are required or willing to participate in that procedure.
76. For a cross-border consumer dispute, the consumer may seek information and assistance from the European Consumer Centre in the country where the consumer lives.
77. This complaints procedure does not limit the consumer’s right to submit a dispute to the court competent under applicable mandatory rules.
Article 13 – Personal data
SnapSelect.nl B.V. processes personal data in accordance with the Privacy and Cookie Policy on gustique.eu. The Privacy and Cookie Policy describes, among other matters, the purposes, legal bases, recipients, retention periods and data-subject rights.
Article 14 – Intellectual property
All intellectual-property rights relating to GUSTIQUE, gustique.eu and the associated text, images, design, trade names and logos remain with SnapSelect.nl B.V. or the relevant licensor. Personal, non-commercial use is permitted. Further use requires prior permission unless otherwise provided by law.
Article 15 – Amendments
78. SnapSelect.nl B.V. may amend these terms for future orders.
79. An order remains governed by the version in force when that order was placed.
80. An amendment will not be applied retrospectively to a consumer’s detriment.
Article 16 – Severability
If a provision is wholly or partly invalid or unenforceable, the remaining provisions continue to apply. To the extent possible, the invalid provision will be replaced by a valid provision that achieves a similar purpose without restricting mandatory consumer protection.
Article 17 – Governing law and jurisdiction
81. The contract and these terms are governed by Dutch law.
82. If the consumer is habitually resident in another EU country, this choice of law does not deprive the consumer of the protection of the mandatory consumer laws of that country.
Disputes will be submitted to the court that has jurisdiction under the applicable mandatory rules.
